Status Report on TN Humana Health Plans

On March 28, 2019, the U.S. District Court for the District of Columbia struck down parts of the Association Health Plan (AHP) rule finalized by the Department of Labor that expanded access to health insurance benefits through said plans.

As a result, Humana, Tennessee REALTORS® medical plan provider, was left with no choice but to forgo renewal of the association's medical AHP. Federal law required Humana to provide a 90-day notice of termination for the plan. Humana sent notice communicating to enrolled members that their medical policy would terminate at midnight on May 31, 2020.

As of June 1, those without insurance will be eligible to join other plans immediately because their insurance was terminated. To assist those with individual coverage in locating alternate medical plans, Tennessee REALTORS® is directing medical enrollees to HealthCare.gov and the Tennessee Farm Bureau.

Policies obtained through HealthCare.Gov will be ACA compliant, i.e. pre-existing conditions will be covered and WellCare is included. The Tennessee Farm Bureau's medical plans are not ACA compliant; therefore, pre-existing conditions may not be covered. Check with the Tennessee Farm Bureau when enrolling to verify coverage.

Since the AHP medical policy will terminate before the next HealthCare.gov open enrollment period, enrollees may be required to provide documentation of your loss of coverage. The letter you received from Humana should fulfill the requirement for documentation.

For those with group coverage through the AHP, the association's partner group, HUB International, will obtain group quotes for your consideration. Members whose spouses are enrolled in a group policy have the option of enrolling on their spouse's plan, as losing coverage is a qualifying event.

Coverage provided by dental and vision policies obtained through the AHP will continue. Dental and/or vision plan enrollees will receive more information in the coming weeks regarding the next open enrollment for dental and vision coverage.

Tennessee REALTORS® will continue to fight to offer health insurance to members. Its leadership and lobby teams have explored every option, and the association is working with the National Association of REALTORS® and the U.S. Dept. of Labor on all possibilities. MAAR will provide updates on the state's AHP policies as it becomes available.
